A winning bid is a legal binding agreement

  • A winning bid is a binding contract for sale with specified monetary damages for failure to complete the contract for purchase. 

  • Parents and Legal Guardians can and will be held responsible, under law, for the completion of bids made by minors under their care.  Similarly, holders of auction service accounts will be held legally responsible for any bid placed with their account:  Do not give your password to anyone. By doing so, you are giving them power-of-attorney to bid for you, and accepting full responsibility for completing purchase of any winning bids.

  • Bidder/buyer understands and agrees that if Bidder/buyer fails to remit payment via the specified payment methods shown above within 30 days of the completion of the auction, Bidder/buyer is considered in default on this binding, non-revocable contract for purchase, and at such time Bidder/buyer loses all claim to receive said product(s) and agrees to pay SoftByte Systems three (3) times the agreed (bid) price plus of all items purchased, as liquidated damages for failure to perform on this contract.  Bidder/buyer agrees to pay any and all costs incurred by SoftByte Systems, or its assigns, plus any and all court costs, reasonable attorney's fees, and collection and discovery fees subsequent to any judgment.

  • Bidder/buyer agrees that venue is established as Broward County, Florida, for any litigation arising from comments, feedback, ratings, postings or any other communication concerning this transaction or the other party, made by bidder/buyer or seller to any person or persons. Bidder/buyer agrees to pay all court costs and reasonable attorney's fees and collection fees for any such litigation if it should result. 
Warranty
  • MONEY BACK WARRANTY WITHIN 14 DAYS OF RECEIPT. Return for a refund must be authorized within 14 days of arrival. Only continental US. Restocking Fee applies in the amount of 30% of the system cost only. Shipping and Handling is not refundable under any circumstance, Custom orders and software are not refundable.
  • The period of the warranty is 1 years parts and 90 days labor.  Warranty excludes any form of physical damage regardless of the cause. Additional Manufacturers warranties may apply.
  • Warranty cover repairs or replacement of defective items and doesn't cover damaged due to misused or negligence.
  • Warranty does not cover any system that have been alter on tamper with in any way without authorization from Soft Byte System.  It is at the sole discretion of Soft Byte System to accept for service any system that has been altered.
  • Items physically damaged over shipping must be reported immediately (within 24hrs) of arrival.  A claim must be filed immediately with the carrier for the damage.
  • Buyer is responsible for all shipping cost for warranty enforcement after the 15 days DOA period from shipping date.  During the DOA period, the buyer will be responsible only for return shipping cost with a valid warranty claim.
  • Items returned for service and found non-defective or not cover by warranty are subject to a testing and processing charge.
  • SoftByte Systems unfortunately cannot offer warranty service for claims based on software or operating system configuration or driver installation and configuration issues.
  • Bidder/buyer agrees to all terms and conditions of sale herein, including shipping/packing/insurance fees and restocking fees.
